Privacy Policy

This Privacy Policy explains how we collect, use, process, and disclose your information across the Kelp Play Digital Website. If you see an undefined term in this Privacy Policy, it has the same definition as outlined in our Standard Terms and Conditions.

When this policy mentions "Kelp Play", "we", "us", or "our", it refers to Kelp Play (Pty) Ltd who is responsible for your information under this Privacy Policy and the Protection of Personal Information Act, 4 of 2013 (POPIA) (the "Data Controller").

In this policy, "Kelp Play Digital Website" means the Kelp Play Application (App) and/or the Digital Website at www.kelpplay.com

POPIA Compliance

Kelp Play complies with the Protection of Personal Information Act, 4 of 2013 (POPIA). This section outlines your rights under POPIA and how we handle your personal information:

  • Right of Access: You have the right to request access to the personal information we hold about you.
  • Right to Correct: You have the right to correct inaccurate, incomplete, or outdated personal information.
  • Right to Delete: You have the right to request deletion of your personal information, subject to legal retention requirements.
  • Right to Object: You have the right to object to the processing of your personal information for certain purposes.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with the Information Regulator at complaints.IR@justice.gov.za

INFORMATION WE COLLECT

There are three general categories of information we collect.

1.1 Information You Give Us

We collect information you share with us when you use the Kelp Play Digital Website.

Account Information: When you register on the Kelp Play Digital Website, we require certain information such as your name, mobile number, and email address.

Profile & Website Feature Information: To use certain features within the Kelp Play Digital Website, we may ask you to complete a profile, which may include your address, phone number, and delivery preferences.

Other Authentication-Related Information: To help create and maintain a trusted environment and to provide the offered services, we may collect identification (like a photo of your government-issued ID) or other authentication information.

Payment Information: Payment information may be collected by a third-party payment processor we utilise for the processing of payments. Kelp Play does not keep any full payment card details. Payment information is subject to the payment processor's privacy policy.

Communications with Kelp Play: When you communicate with Kelp Play or use the Kelp Play Digital Website to communicate with us, we collect information about your communication and any information you choose to provide.

Other Information: You may otherwise choose to provide us with information when you fill in a form, conduct a search, update or add information to your Kelp Play Account, respond to surveys, post to community forums, participate in promotions, or use other features of the Kelp Play Digital Website.

1.2 Information We Automatically Collect

When you use the Kelp Play Digital Website, we collect information about the services you use and how you use them.

Usage Information: We collect information about your interactions with the Kelp Play Digital Website, such as the pages or other content you view and other actions on the Kelp Play Digital Website.

Location Information: When you use certain features of the Kelp Play Digital Website, we may collect different types of information about your general location (e.g. IP address, postal code) or more specific location information (e.g. precise location from your mobile GPS).

Log Data: We automatically collect log information when you use the Kelp Play Digital Website. That information includes, among other things: details about how you've used the Kelp Play Digital Website, IP address, access times, hardware and software information, device information, device event information, and the page you've viewed or engaged with before or after using the Kelp Play Digital Website.

Transaction Information: We collect information related to your transactions on the Kelp Play Digital Website, including the date and time, amounts charged, and other related transaction details.

Cookies and Similar Technologies: We use cookies and other similar technologies, such as web beacons, pixels, and mobile identifiers. Most browsers allow you to disable cookies through your browser settings.

1.3 Information We Collect from Third Parties

We may collect information that others provide about you when they use the Kelp Play Digital Website, or obtain information from other sources and combine that with information we collect through the Kelp Play Digital Website.

Third Party Services: If you link, connect, or login to your Kelp Play Digital Website account with a third party service (e.g., Facebook, Google), the third party service may send us information such as your registration and profile information from that service.

Other Sources: To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners.

Third-Party Service Providers

Kelp Play uses the following categories of third-party service providers:

  • Payment Processing: Payment processors who handle credit card and transaction data.
  • Identity Verification: Services that verify customer identity and conduct background checks.
  • Fraud Prevention: Fraud detection and risk assessment services.
  • Analytics: Website analytics and usage tracking services.
  • Customer Support: Third-party support platforms and communication tools.

Specific service provider details are available on request from privacy@kelpplay.com. All third-party service providers are contractually bound to protect your personal information in accordance with POPIA.

HOW WE USE INFORMATION COLLECTED

We use, store, and process information about you to provide, understand, improve, and develop the Kelp Play Digital Website, and to create and maintain a trusted and safer environment.

2.1 Provide, Improve and Develop Services

  • Enable you to access and use the Kelp Play Digital Website.
  • Operate, protect, improve and optimise the Kelp Play Digital Website and experience, such as by performing analytics and conducting research.
  • Personalise or otherwise customise your experience by, among other things, ranking search results or showing ads based on your use.
  • Enable you to access and use payment services.
  • Provide customer service.
  • Send you service or support messages, such as updates, security alerts, and account notifications.

2.2 Create and Maintain a Trusted Environment

  • Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.
  • Conduct investigations and risk assessments.
  • Verify or authenticate information or identifications provided by you.
  • Conduct checks against databases and other information sources.
  • Comply with our legal obligations.
  • Resolve any disputes with any of our users and enforce our agreements with third parties.
  • Enforce our Standard Terms and Conditions and other policies.

2.3 Advertising and Marketing

  • Send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your communication preferences.
  • Personalise, measure, and improve advertising.

Legal Basis for Processing

We process your personal information based on the following legal grounds under POPIA:

  • Contract: Processing necessary to perform our contract with you (e.g., delivering Products, processing payments).
  • Consent: Processing based on your explicit consent (e.g., marketing communications).
  • Legal Obligation: Processing required by law (e.g., tax compliance, fraud prevention).
  • Legitimate Interest: Processing necessary for legitimate purposes such as fraud prevention, security, and service improvement.

SHARING & DISCLOSURE

3.1 With Your Consent

We may share your information at your direction or as described at the time of sharing, such as when you authorise a third party application or Digital Website to access your Kelp Play details.

3.2 Service Providers

We use a variety of third party service providers to help us provide services related to the Kelp Play Digital Website. All service providers are contractually required to maintain the confidentiality and security of your personal information.

3.3 Safety and Compliance with Law

Kelp Play may disclose your information to courts, law enforcement or governmental authorities if required to do so by law or if such disclosure is reasonably necessary for legal compliance, national security, or to maintain legitimate interests.

We will attempt to notify you about legal requests unless providing notice is prohibited by law or would be futile or create risks.

3.4 Business Transfers

If Kelp Play undertakes or is involved in any merger, acquisition, reorganisation, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all our assets, including your information. In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

3.5 De-identified Data

We may share de-identified information for industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

Data Retention

We retain personal information for as long as necessary to provide our services. Specific retention periods:

  • Account Data: Retained for the duration of your account and for 2 years after account deletion, unless required longer by law.
  • Transaction Data: Retained for 7 years to comply with South African tax and legal requirements.
  • Marketing Data: Retained until you opt-out or for 3 years from last interaction, whichever is sooner.
  • Analytics and Cookies: Typically retained for 12 months.

Upon termination of your account, we will delete or anonymise your personal information within 30 days, except where we are required to retain it by law.

THIRD PARTY PARTNERS & INTEGRATIONS

The Kelp Play Digital Website may contain links to third party Websites or services. Kelp Play does not own or control these Third Party Partners and when you interact with them, you may be providing information directly to the Third Party Partner, Kelp Play, or both. We encourage you to review the privacy policies of the other Websites you visit.

YOUR CHOICES

5.1 Access and Update

You may review, update or delete the information in your Kelp Play Account by logging into your account and reviewing your Account settings and profile. You may also contact our Data Protection Officer at privacy@kelpplay.com to request access to or correction of your personal information.

5.2 Account Cancellation

You may request cancellation of your Kelp Play account at any time by contacting support@kelpplay.com or through your Account settings. Your account will be deactivated within 2 business days. Your personal data will be retained in accordance with the data retention schedule above.

5.3 Marketing Communications

You may opt-out of marketing communications at any time by clicking the "Unsubscribe" link in our emails or by contacting support@kelpplay.com. Please note that even if you opt-out of marketing communications, we will continue to send you service-related notices and messages.

5.4 Security

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorised access, loss, destruction or alteration. However, the Internet is not a 100% secure environment so we cannot guarantee the security of the transmission or storage of your information.

5.5 Data Breach Notification

If we become aware of a data breach that compromises your personal information, we will notify you within 30 days of discovery (or as otherwise required by POPIA). The notification will describe the nature of the breach, the types of information affected, and the steps we are taking to address the breach.

5.6 Changes to this Privacy Policy

Kelp Play reserves the right to modify this Privacy Policy at any time. If we make changes, we will post the revised Privacy Policy on the Kelp Play Digital Website and provide you with notice of material modifications by email at least 30 days before the date they become effective.

If you disagree with the revised Privacy Policy, you may cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access or use of the Kelp Play Digital Website will constitute acceptance of the revised Privacy Policy.
